Terms of Service

Welcome to Birdify! By creating an account, running our CLI commands, or integrating our SDK, you agree to comply with and be bound by the following Terms of Service. Please read them carefully before using our developer tools.

1. Description of Service

Birdify provides a cloud-based over-the-air (OTA) live patching utility designed for mobile application frameworks like Flutter and React Native. The service allows you to inject lightweight code fixes and updates directly into compiled apps running on end-user devices, bypassing traditional App Store review wait times.

2. Eligibility & Account Security

• Account Status: You may register as an Individual/Freelancer or as a Corporate Entity. You are responsible for ensuring your registration parameters accurately reflect your legal operational status.
• Security: You are solely responsible for protecting your Birdify API keys, CLI auth tokens, and session passwords. Any deployment executed via your credentials will be deemed authorized by you.

3. Subscriptions, Fees, and Cancellations

• Billing Cycle: Birdify operates on a monthly recurring subscription model.
• Payment Authorization: By activating a plan, you authorize our third-party payment aggregators to automatically charge your chosen payment method at the start of each billing cycle.
• Regional E-Mandates (India): If you are subscribing using an Indian debit or credit card, transactions are governed by the Reserve Bank of India (RBI) e-mandate rules, including multi-factor authentication and pre-debit notifications.
• Cancellation: You can cancel your subscription at any time through your web dashboard interface. Upon cancellation, your access to push new patches will stop at the end of the current billing cycle.

4. Acceptable Use and Restrictions

You explicitly agree not to use Birdify to deploy patches that:

• Introduce malicious payloads, spyware, ransomware, or unverified tracking scripts.
• Violate the developer distribution agreements, guidelines, or policies of the respective Apple App Store or Google Play Store.
• Attempt to bypass or break the structural runtime sandboxing of the user’s mobile operating system.

5. Limitation of Liability & Warranties

Birdify is provided "as is" and "as available". While we strive for maximum cloud infrastructure availability, we do not warrant that patch delivery will be 100% uninterrupted, lightning-fast, or completely error-free across all global networks or device states. In no event shall Birdify be liable for any lost profits, app store rejections, or corrupted app builds resulting from your deployment pipelines.

6. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any legal actions or disputes must be filed in the appropriate court system matching our operational headquarters.
